Position Overview:
The Counterfeit Investigations Officer is responsible for executing the brand protection strategies for Risk and Security Management in Australia and New Zealand. Partnering with major national and global companies, the officer will play a critical role in identifying counterfeit products in the market and working to prevent the sale and distribution of such goods.
This role involves coordinating field agent networks, managing market sweeps, investigating counterfeit activities, and providing in-depth, insightful reporting to clients.
Key Responsibilities:
1. Counterfeit Identification & Investigation
• Collaborate with clients to understand their brand protection needs and identify potential counterfeit threats in the market.
• Investigate and monitor potential counterfeit products across various channels, including online platforms, physical stores, and distribution networks.
• Coordinate covert surveillance and gather evidence on suspected counterfeit goods.
2. Field Agent Coordination & Market Sweeps
• Schedule and coordinate a network of field agents for regular market sweeps, ensuring efficient coverage in both Australia and New Zealand.
• Oversee and manage the process of market surveillance, including physical store visits and sweeps in key regions and product categories.
• Provide guidance to field agents on identifying and reporting counterfeit products, ensuring adherence to legal and ethical standards.
3. Client Reporting & Data Analysis
• Prepare detailed, accurate, and timely reports for clients regarding market sweeps, counterfeit product findings, and enforcement actions.
• Analyse findings and offer strategic insights to clients on how to mitigate counterfeiting risks and improve brand protection efforts.
• Provide clients with periodic updates and real-time alerts on identified counterfeit activities or trends in the market.
4. Legal & Enforcement Action Support
• Assist with the preparation and execution of cease and desist letters to entities involved in counterfeit activities.
• Work closely with legal teams and government authorities to support enforcement actions and ensure compliance with Australian and New Zealand intellectual property laws.
• Collaborate with law enforcement, customs, and other regulatory bodies as needed for counterfeiting investigations.
5. Stakeholder Engagement & Partnership Development
• Build and maintain strong relationships with key stakeholders, including clients, government agencies, law enforcement, and industry groups.
• Engage in collaborative partnerships with international brand protection teams to share intelligence and best practices.
• Represent the company at anti-counterfeiting events, forums, and conferences, staying updated on emerging trends and legislation.
Skills & Qualifications:
• Experience: Minimum of 1 year of experience in anti-counterfeiting, brand protection, or intellectual property enforcement, ideally with a background in field investigations or market surveillance is desired however transferrable skills will be considered.
• Knowledge: Strong understanding of Australian and New Zealand IP laws, counterfeit identification, and enforcement practices is desirable.
• Technical Skills: Proficient in using all MS Office products, market monitoring platforms, and reporting software. Familiarity with online platforms (e.g., e-commerce sites) and their role in counterfeit distribution is an advantage.
• Communication Skills: Excellent written and verbal communication skills with the ability to prepare detailed reports and interact effectively with clients, stakeholders, and law enforcement.
• Problem-Solving: Strong analytical and investigative skills with the ability to identify trends, assess risks, and develop strategic action plans.
• Attention to Detail: Exceptional attention to detail and thoroughness in conducting investigations and reporting.
• Legal Acumen: Knowledge of cease and desist procedures, trademark enforcement, and working within the legal framework of intellectual property laws in Australia and New Zealand is desirable.
