Position Summary:
We are seeking a skilled and motivated lawyer with a minimum of 3 years' post-qualification experience (PQE) to join our client's Restructuring and Insolvency team. The successful candidate will have a strong background in restructuring, turnaround, and insolvency or substantial experience in commercial litigation with a desire to specialise. This position offers the opportunity to work on complex and high-profile matters across a range of industries, providing strategic advice and practical solutions to clients.
Key Responsibilities:
- Provide legal advice and support on restructuring, turnaround, and insolvency matters, including corporate recovery proceedings, voluntary administrations, liquidations, bankruptcy, receiverships, and insolvency in the context of trusts.
- Manage dispute resolution processes, including drafting affidavits and submissions, instructing counsel, and handling appearance work in the Supreme Court and Federal Court.
- Advise clients on the application of the Personal Property Securities Act (PPSA) and other relevant legislation.
- Assess and establish solvency and insolvency, including the ability to interpret and analyse financial statements, cashflow forecasts, and bank records.
- Assist with safe harbour matters and provide practical guidance on compliance and risk management for directors and companies.
- Prepare and review legal documentation relating to external administration processes.
- Collaborate with internal teams and external stakeholders to deliver strategic legal solutions in complex and sensitive matters.
- Conduct legal research and provide analysis to support case strategy and client advice.
- Minimum of 3 years' PQE in restructuring and insolvency or a combination of commercial litigation and insolvency.
- Strong dispute resolution experience, including drafting affidavits, submissions, and managing court appearances (Supreme Court/Federal Court preferred).
- Baseline knowledge and/or experience in the following areas:
- Restructuring, turnaround, and insolvency in Australia.
- Personal Property Securities Act (PPSA).
- Establishing solvency and insolvency (including financial analysis and review).
- Safe harbour provisions and director responsibilities.
- Corporate recovery and external administration proceedings.
- Voluntary administrations and deeds of company arrangement (DOCA).
- Liquidations and wind-up proceedings.
- Bankruptcy and personal insolvency.
- Receiverships and asset recovery.
- Insolvency and trusts.
- Advanced Insolvency (ARITA) qualification or willingness to pursue the qualification (preferred but not required).
- Strong commercial drafting skills, particularly in the context of external administration matters.
- Excellent analytical and problem-solving capabilities with attention to detail.
- Ability to manage competing priorities and work effectively under pressure.
- Strong communication and interpersonal skills to engage with clients and stakeholders effectively.
- A proactive and solutions-focused approach to client matters.
- Ability to work both independently and as part of a collaborative team.
