The team
ASIC's Enforcement and Compliance Group (ECG) is responsible for the conduct of ASIC's initial inquiries, compliance and enforcement work across all sectors excluding markets. The ECG comprises Enforcement Inquiries and Compliance, Investigation and Special Operations Teams and Enforcement Services.
The ECG Investigation Teams are responsible for conducting investigations to establish whether there have been contraventions of the law with a view to undertaking appropriate enforcement action.
The Small Business Enforcement (SBE) Team is an ECG investigation team, responsible for protecting the interests of small businesses and small business creditors. The SBE team conducts investigations into insolvent companies and non-compliance by directors and officers of insolvent companies of their statutory obligations under the Corporations Act.
SBE team investigations can lead to administrative proceedings to ban persons from managing corporations, orders to undo a creditor defeating disposition and criminal proceedings relating to illegal phoenix activity and misappropriation of company assets.
The role
As a SBE Team Leader, you will make an important contribution to the SBE Melbourne Team (and to other SBE teams located in Brisbane, Sydney, Perth and Adelaide) by managing and providing strategic guidance to team members and overseeing a high-volume and variety of cases to deliver on key enforcement priorities and outcomes.
You will be responsible for:
* Planning and scoping investigations, identifying the most appropriate investigative approach.
* Analysing collected evidence utilising technology and relevant legal knowledge and developing appropriate case theories and actively progress investigations.
* Identifying risks and issues arising in investigations that present challenges and implementing strategies to overcoming these challenges.
* Compiling briefs for the Commonwealth Director of Public Prosecution (CDPP) and assisting them to prepare and conduct criminal prosecutions.
* Supporting Enforcement Legal Services in commencing and conducting administrative, civil and / or criminal litigation in the Supreme and/ or Federal Courts, including briefing and instructing Counsel.
* Compiling administrative briefs to ASIC delegates, liaising with delegates and representing ASIC at administrative hearings.
About you
With your demonstrated experience in a role that involved investigation, case management or detection of misconduct, including the preparation of criminal briefs of evidence, you will have the technical expertise and specialist skills to assist ASIC in providing solutions on complex investigations and achieve impactful outcomes. Your experience includes management skills, excellent written and verbal communication skills, and the ability to manage effective stakeholder relationships.
You will also demonstrate:
* Strong investigative and analytical skills with significant experience planning and managing investigations and projects through to conclusion and in accordance with project timelines.
* Planning and organising skills and ability to manage multiple tasks and meet timeframes.
* Adept at using technology with an ability to use digital investigative tools.
* Tertiary qualifications in law, commerce, accounting, criminology, or other relevant discipline will be highly regarded.
